Terms of Service
Effective Date: 17/08/2026 | Version: 1.0 | Next Review: 17/08/2027
These terms govern use of the PowerView UK platform, the free Risk Check and all paid compliance reports. They are governed by the laws of England and Wales.
1. Who we are
PowerView UK (Annalu Pomarico, sole trader) ("PowerView", "we") provides compliance auditing software for licensed UK energy suppliers. "You" means the supplier organisation accepting these terms.
2. Free Risk Check is a sample, not advice
The free Risk Check is a sample analysis of a limited data set (up to 200 MPANs). It is provided for evaluation only, without warranty, and is not legal, regulatory or financial advice. Nothing in a Risk Check creates a professional adviser relationship.
3. Paid reports are compliance assistance
Paid reports are compliance assistance tooling. Final responsibility for compliance with the Gas and Electricity Supply Licences, including all Standard Licence Conditions, rests entirely with you as the Ofgem licence holder. PowerView does not act as your compliance officer, does not make regulatory submissions on your behalf, and is not a substitute for legal advice or internal governance.
4. Estimated exposure figures
Any monetary figure is an indicative screening estimate derived from the bill date, consumption period, validated-versus-billed consumption, charge days, tariff and VAT data you supply. Missing evidence is shown as not quantified. It is not a guarantee of recoverable revenue, of a redress amount, of an Ofgem penalty, or of any financial outcome. Figures must be validated against your own billing systems before being relied on, reported or disclosed.
5. Your data and your obligations
- You remain the data controller for all customer data you upload; PowerView is a processor acting on your documented instructions.
- You confirm you are authorised to upload the data, that it was lawfully obtained, and that direct identifiers (names, addresses) have been removed where not required.
- You are responsible for the accuracy and completeness of uploaded data. Analysis quality depends entirely on input quality.
- You must not use the platform to process special category data beyond PSR indicators.
6. Availability
The service is provided on an "as available" basis. Planned maintenance is notified where practical. Enterprise SLAs, if agreed, are set out in the order form and prevail over this clause.
7. Limitation of liability
Nothing limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability that cannot lawfully be excluded under English law.
Subject to that, PowerView is not liable for regulatory fines or redress imposed on you, loss of profit, loss of revenue, loss of anticipated savings, loss of goodwill, or any indirect or consequential loss. PowerView's total aggregate liability arising out of or in connection with the service is limited to the fees paid by you in the 12 months preceding the event giving rise to the claim, and to £100 in respect of the free Risk Check.
8. Termination
Either party may terminate a subscription at the end of its term on 30 days' notice. On termination we retain audit records for the 6-year period described in the Privacy Policy and export your data on request.
9. Governing law
These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
